Metris Party Wall Solutions is operated by Paul Kennedy MFPWS, based in Chichester, West Sussex. Paul Kennedy is the data controller for all personal data collected through this website. As a member of the Faculty of Party Wall Surveyors, Paul Kennedy is also bound by the Faculty’s Code of Conduct, which requires that clients’ personal details remain private and confidential save with their consent or where disclosure is required by law.

2.1 Contact Form

We intentionally limit the data we collect to your own personal details. We do not knowingly collect or process the personal data of adjoining owners, neighbours, or other third parties submitted through our website, and we ask that you do not include such information in your enquiry.

2.2 Notice Checker Tool

When you consent to use our Notice Checker tool, we collect your name to personalise your session. We retain your name and the content of your Notice Checker session — including your question and the tool's generated response — for one month, to maintain an accurate record of the guidance provided. After one month this data is securely deleted.

If you choose to provide your email address at the end of a Notice Checker session to request a follow-up from Paul, that email address will be retained and handled in the same way as contact form data.

3. How We Use Your Personal Data

We process your personal data for the following purposes and on the following lawful bases:

  • Responding to your enquiry. Lawful basis: Legitimate interests.
  • Providing the Notice Checker assessment response. Lawful basis: Consent.
  • Managing your matter if you proceed to a party wall appointment. Lawful basis: Contract.
  • Maintaining records for professional and legal compliance. Lawful basis: Legal obligation.
  • Preventing fraud and ensuring website security. Lawful basis: Legitimate interests.

4. Automated Processing

Our Notice Checker tool uses an artificial intelligence model (Claude, provided by Anthropic), guided by a proprietary system of statutory rules and safeguards developed by Paul Kennedy MFPWS. The tool does not generate free-form answers — it follows structured logic for identifying relevant sections of the Party Wall etc. Act 1996, applies mandatory hedging language, and is restricted from making legal determinations, quoting fees, or resolving boundary disputes. This structured logic is designed solely for preliminary guidance and does not replicate, replace, or simulate professional judgment. These responses are general guidance only and do not constitute professional advice.

This processing does not constitute automated decision-making with legal or significant effect within the meaning of UK GDPR Article 22. No decisions about your legal rights, obligations, or professional status are made solely by automated means. All statutory assessments require professional verification by Paul Kennedy MFPWS before any notice is served.

5. Who We Share Your Data With

We do not sell your personal data or share it with third parties for marketing purposes. We use the following data processors who handle personal data on our behalf:

  • HubSpot (USA): CRM — stores contact enquiries and matter records.
  • Google (USA): Cloud storage — manages matter folders and associated files.
  • Anthropic (USA): AI processing — works descriptions used to generate preliminary assessments.
  • Vercel (USA): Website hosting — processes technical data associated with website requests.

We will never use the information you provide to make unsolicited approaches to your neighbours or any other third party.

6. Cookies

Our website uses only strictly necessary cookies — small text files essential for the website to function correctly. These include cookies used by our hosting infrastructure for security purposes, and session cookies that preserve your inputs within the Contact Form and Notice Checker during a single visit.

We do not use analytics cookies, advertising cookies, or any cookies that track you across other websites. Because we use only strictly necessary cookies, no cookie consent banner is required. Full details are set out in our Cookie Policy.

7. How Long We Keep Your Data

  • Enquiries that do not proceed to an appointment: Retained for one month from your last contact, then securely deleted.
  • Live party wall matters: Retained for six years from the conclusion of the matter, in line with the standard limitation period for professional liability claims.
  • API audit log: Where our public API endpoint is used, we retain a pseudonymised record of the request and response for twelve months for the purposes of security monitoring, abuse prevention, and maintaining an accurate record of API activity. IP addresses are stored as irreversible cryptographic hashes and cannot be used to identify individuals directly. Lawful basis: Legitimate interests.

8. Your Rights

Under the UK GDPR, you have the right to access, rectify, erase, restrict, or port your personal data, and to object to processing based on legitimate interests. To exercise any of these rights, please contact Paul Kennedy using the details in Section 9.
